Called to Order at 7:30 PM under M.G.L. Chapter 131, s.40 and the Hanson By-Law 1-13, s.5. by Philip Lindquist, Chairman, in Meeting Room A on the top floor at the Town Hall.

Public Hearings

7:30 PM Continued Notice of Intent for the construction of an addition to an existing dwelling and a septic repair at 263 Woodbine Ave., Map 2, Lot 42, 43 for John Barilaro represented by Grady Consulting, LLC, 6 Grays Beach Rd., Kingston, MA  (DEP #175-0488)

Gary Walcott from Grady Engineering presented a revised plan as requested by the Commission at the last meeting.  The new plan demonstrated that the addition had been reconfigured to meet the 50-foot no disturb setback.

7:45 PM Notice of Intent for the repair of a septic system that includes the installation of a 2500 gallon tight tank, to raze an existing structure and using the same footprint, construct a foundation slab with a two-story structure at 81 Ocean Ave., Map 47, Lot 1501 for Barbara Spencer represented by Land Planning, Inc., 1115 Main St., Hanson, MA  (DEP #175-0487)  (New Hearing)

Dave Harris read the revised Public Hearing Notice and the abutters were verified.  Bob Crowell of Land Planning made the presentation.  Because of the close proximity of wetlands on either side of the property as well as being directly adjacent to Monponsett Lake, the proposal calls for a 2,500 gallon tight tank.  The septic system has been Board of Health approved and the plan has been sent to DEP for their approval.  The proposal also calls for a foundation crawl space using the same footprint as the current structure.  Mr. Kevin Smith was asked not to perform any more cutting along

the edge of the lake and to let some of the vegetation grow back in to provide a buffer to the shoreline.  Phil Lindquist read the abutters list.  None were present.

8:00 PM Continued Request to Amend an Order of Conditions to allow a modification to relocate garages at 255 Rear Liberty Street, Assessors Map 82, Lot 6-1 for Dennis Leary, Trustee for Hudson Park Associates, N.T., 2 Columbia Rd., Pembroke, MA  02359   (DEP #175-0433) – cancelled and continued per request of applicant.  Rescheduled to February 28th at 8:15 PM.

8:15 PM  Request to Amend an Order of Conditions with a revised plan demonstrating a change in the size of the building, associated parking and the redesign of the stormwater basin at 23 Commercial Waye, Map 59, Lots 17-7 & 17-8 for Chris Pongratz represented by Merrill Associates, 427 Columbia Road, Hanover, MA (DEP #175-466)

Dave Harris read the Public Hearing notice and the abutters were verified.  Chris Pongratz attended as well as Dana Attabello and Seth Krueger from Merrill Associates.   Revised site plans addressing the comments made by the Commission’s Review Engineer, Tom Sexton were submitted the day of the meeting.  Therefore, not much time was allowed for the agent and/or Commission to review the changes.  Mr. Pongratz made a presentation itemizing the proposed amendments he would like to make from the original plan.  The size of the parking lot had been increased and the building had been redesigned to accommodate nine tenants instead of four. A third basin had been added for additional stormwater runoff.  Some of Ms. Delaney’s concerns were that the septic was designed too close to the basin, the O & M plan should be enhanced to reflect Pre & Post plans with evaluation checklists and that reference tenant agreements, a NPDES permit is required and should have been filed before the lot was cleared.   Mr. Lindquist asked for comments from abutters:

Steve Buckley, 68 Industrial Blvd.:  Had a question about proximity of building to his property line.  Also had concerns with runoff.

8:30 PM  Notice of Intent for the construction of a single family house, septic system, driveway, utilities & site grading at 622 Main Street, Assessor’s Map 41, Lot 3 for Thomas Mullen, T & B Realty Trust, 16 Arthur Matthew Drive, Hanover, MA represented by Land Planning, Inc.  (DEP #SE175-490)  (New Hearing)

Dave Harris read the public hearing notice and the abutters were verified.  Bob Crowell made the presentation.  Most of the work is outside of the 100-foot buffer zone.  Two test holes had been dug inside the 50-foot no disturb zone.  The house has been razed.  Haybales are proposed around the limit of work.   Ms. Delaney recommended a Negative Determination of Applicability because the work is minimal inside the buffer zone.

Above Ground Swimming Pool Permit for 19 Woodbrook Lane, Assessor’s Map 115, Lot 5-18A utilizing the Blanket Determination of Applicability –  This is the first filing for this procedure.  Ms. Delaney signed the Building Permit and the fee had been paid.

Letter from Kopelman & Paige regarding Order of Conditions and update on erosion control for “Stonebridge Commons” (DEP #175-366) – reviewed additional erosion control, Phase II has begun.

Letter  from the Division of Fisheries & Wildlife regarding posting of a “No Hunting” sign on Conservation Land off Holmes Street

Homeowners off Holmes Street attended the meeting to voice their concerns with hunters accessing deer through a conservation parcel on Holmes Street.  Their opposition was not to hunting, but the fact that it was within 500 feet from theirs and other residences.   Such activity is against State Regulations designed for safe hunting activities.   Ms. Delaney had published a press release in the Hanson Express reminding hunters of the regulations.  Also, a No Hunting sign will be posted at the property in question.

Bio-Diversity Days - reviewed
ZBA letter regarding:  775 West Washington Street – Ms. Delaney had inspected the property with the Building Inspector.  There had been historic alteration of wetlands.  Mr. Grattan said there was a history of enforcement issues.  Ms. Delaney will research.
22 Industrial Blvd. – The Conservation Commission had permitted this project.  The owner, Chris Pongratz addressed a condition that specified tenants come before the Commission.  He required new owners to sign an affidavit acknowledging receipt of the Orders of Conditions and they are also required to go to the ZBA and testify as to their intent.
13 West Washington Street  (DEP #SE175-394) – Ms. Delaney had signed a temporary Occupancy Permit, however she has concerns about disturbance within the 50-foot buffer zone.  She will write a letter to the owner.
